The subject-matter of this suit, when the pleadings were filed and the issues made up, was the title to a tract of about forty-one acres of land in Davidson county, Tennessee. Pending the suit the land in controversy has been sold to the City of Nashville and the purchase price $9,500) has been paid into the registry of the chancery court.
