In an action to recover damages for an assault and battery allegedly committed by defendant Hook during the course of his employment, said defendant and his employers, the defendants Canon and Eli Service Station, appeal from an order of the Supreme Court, Queens County, dated July 23, 1962, which denied their separate motions to dismiss the complaint for lack of prosecution. *711Order affirmed, on the condition that, within 30 days after entry of the order hereon, plaintiff shall pay one bill of $50 costs and disbursements to defendants Canon and Eli Service Station and another bill of $50 costs…
