PATTEE, Superior Judge.

This case was once heard and the judgment appealed from affirmed. 20 Ariz. 485, 181 Pac. 577. A rehearing was thereafter granted, and the cause submitted upon additional briefs and oral argument. The action was brought by Biley Bryan, as administrator of the estate of Allen Bryan, deceased, to recover damages caused by the death of the intestate under the Arizona Employers’ Liability Act (Chapter 6, tit.
