CAFFREY, Senior District Judge.

This matter comes before the Court on a petition for habeas corpus relief submitted. by Charles Brown, who is currently serving a life sentence for murder in the first degree. After a jury trial, petitioner was found guilty and sentenced on May 17, 1976. The conviction was affirmed on direct appeal to the Supreme Judicial Court. Commonwealth v. Brown, 376 Mass. 156, 380 N.E.2d 113 (1978).
