APPEAL from the Twenty-sixth District Court, Parish of St. Charles. Kahn, J.

1Opinion of the Court

On Motion of Heirs to Dismiss.

The opinion of the Court was delivered hy

Manning, J.

Judgment was rendered against Denis Meng, the administrator, on the opposition of the heirs to his account, from which he appealed. The ground of the motion is that he has appealed as administrator from a judgment against him in favour of the succession.

The appeal bond is signed in his individual capacity, aud the motion for appeal recites that, it is made for “ Meng against whom judgment has been rendered,” etc.

Motion refused.

On Motion oe Administrator to Dismiss.

The opposition of one of the heirs was dismissed…
