This action is for breach of an agreement in writing, under seal, for the purchase of certain land from the plaintiff by the defendants. The time for performance is indicated by two clauses ; one that “ said premises are to be conveyed within thirty days from this date; ” the other that “ in case the said parties of the second part should fail to sell their estate at the expiration of the thirty days, then we agree to extend this agreement for thirty days.” The inference from the latter clause is that the defendants were to have the whole thirty days for performance on their part, and, in the…
