This military pay case is before the Court on defendant’s motion to dismiss or, in the alternative, for judgment upon the administrative record, and plaintiffs cross-motion for judgment upon the administrative record. Plaintiff, Major Robert Anderson (“Major Anderson” or “Anderson”), seeks pay and separation pay related to time that he avers he would have served in the Army had he not been passed over for promotion to captain in 1993 and consequently not retained on active duty.
