OPINION
SMITH, District, Judge.
The present matter comes before the court on defendant’s motion for summary judgment as to plaintiffs claims for negli gence and unseaworthiness. For the reasons set forth below, the court DENIES the motion.
I. FACTUAL AND PROCEDURAL HISTORY
On June 10, 2002, Kenneth Long, the plaintiff, signed on to the USNS CAPABLE in Norfolk, Virginia, as Steward/Baker. (Final Pretrial Order Stipulation of Facts [“FPO”] ¶ 2, pg. 1).
