This matter comes before the Court on a Motion for Abstention filed by Defendant ARY Jewelers, L.L.C. (“ARY”). ARY requests this Court to abstain from further proceedings in this Adversary Proceeding pursuant to 28 U.S.C. § 1334(c)(1) and Federal Rule of Bankruptcy Procedure 5011 on the grounds that (i) state law issues predominate the action and the Defendants are entitled to a trial by jury; and (n) all but one of the criteria for mandatory abstention pursuant to 28 U.S.C. § 1334(c)(2) are present.
