On March 12, 1968, under the provisions of § 6-63, W.S.1957 (1969 Cumulative Supp.), complaint was filed in Teton County against Keith Rhodes, a 31-year-old male, for the first-degree rape of Paula Ann Nelson, a female child of eight years, the information containing five counts, for offenses on July 22, 29, August 5, 9, and 10, 1967. Prior to the trial the State elected to proceed on count three, which charged an offense committed on or about August 5, 1967.
