The facts necessary to a determination of the questions involved in this case are substantially as follows: In March, 1911, Grace 'Scales, plaintiff in this action, secured a judgment in the district court of Hughes county against the Missouri, Oklahoma & Gulf Railway Company in the sum of $1,177, as payment for a right of way through her land in said county. From this judgment the railroad company appealed 'to the Supreme Court of this state, and, -for the purpose of superseding the judgment and staying execution, executed a supers'edeas bond in the sum of $2.345, with the National 'Surety…
