This matter is before the Court on the Motion for .Summary Judgment (Filing *628No. 22) filed by Plaintiffs Graham Construction, Inc. (“Graham”) and Arch Insurance Co. (“Arch”) (collectively “Plaintiffs”) and the Motion for Summary Judgment (Filing No. 26) (collectively “Motions”) filed by Defendant Markel American Insurance Co. (“Markel”). For the reasons discussed below, Plaintiffs’ Motion will be denied, Markel’s Motion will be granted, and this case will be dismissed with prejudice.
