SUSANO, Judge.

Over a period of 39$ months, the plaintiffs, Carolyn J. Hunt and her husband, Frank Hunt, filed three separate complaints in the trial court against the defendant Mark J. Shaw. The complaints were identical in substance; each sought damages arising out of personal injuries 1 sustained in an automobile accident on December 22, 1990. The trial court granted the defendant’s motion to dismiss the last lawsuit filed by the plaintiffs. The plaintiffs appealed. The basic issue before us is whether the third complaint was timely filed.
