BACKGROUND

Plaintiff, Mary Dale (“Dale”), commenced this action pursuant to 42 U.S.C. § 1983 against defendants William J. Kelley (“Kelley”), an Assistant District Attorney for Livingston County; Charles J. DiPasquale (“Di-Pasquale”), Chief of the Village of Mount Morris Police Department; the Village of Mount Morris (“the Village”); and Livingston County (“the County”).
