RAY, District Judge.

The defendant is a railroad corporation organized and existing under the laws of the state of New York and engaged in the business of a common carrier and in operating and constructing railroads and branches thereof in the state of New York and in the Northern district thereof, and one or more of which branches extend into the Dominion of Canada, kingdom of Great Britain.
