In an action to recover damages for personal injuries, the third-party defendant appeals from an order of the Supreme Court, Kings County (Hall, J.), dated November 19, 2001, which denied its motion for summary judgment dismissing the third-party complaint.
Ordered that the order is modified, on the law, by deleting the provision thereof denying that branch of the motion which was for summary judgment dismissing the first cause of action of the third-party complaint and substituting therefor a provision granting that branch of the motion; as so modified, the order is affirmed, with costs to…
