*404In an action to recover damages for personal injuries, the plaintiff appeals from an order of the Supreme Court, Queens County (Kelly, J.), dated April 16, 2003, which granted that branch of the motion of the third-party defendant which was for summary judgment dismissing the third-party complaint, granted that branch of the cross motion of the defendants which was for summary judgment dismissing the complaint, and denied his cross motion to strike the defendants’ answer.
