I. INTRODUCTION

This case arises out of the alleged sexual abuse of the plaintiff Jay Martin (“Martin”) by the leaders of his Boy Scout troop, Lawrence Brehaut (“Brehaut”), William Berman (“Berman”), and Steven Perry (“Perry”) between approximately 1974 and 1979. On May 17, 2004, Martin filed the complaint in this present action against the defendant Boston Minuteman Council, Inc. (“BMC"), alleging claims for negligence, negligent supervision, negligent infliction of emotional distress, and assault and battery. On December 6, 2005, BMC moved for summary judgment asserting…
