ORDER ADOPTING REPORT AND RECOMMENDATION

Lead Plaintiffs James O’Hern and John O’Hern bring this action against Defendant Chisholm, Bierwolf & Nilson, LLC (“CBN”) alleging violations of Section 10b of the Securities and Exchange Act of 1934 and Rule 10b-5 promulgated thereunder. CBN was employed as an outside auditor to provide independent opinions on financial statements for Atlas Mining Company (“Atlas”).
