Harold Ferris was arrested without warrant by the respondent chief of police. The causes of his arrest and detention are reviewed by a writ of habeas corpus.

Ferris is the credit manager and financial messenger of a substantial business house in the city of Oneonta; his duties require personal conduct of cash to the bank; at the time of arrest he was so engaged, and for protection of himself and the property of his employer he was carrying a pistol.
