Plaintiff/appellant Clyde Davis commenced this action under the Labor-Management Reporting and Disclosure Act (LMRDA), 29 U.S.C. § 401 et seq., alleging that he was expelled from his union in retaliation for exercising his statutory right of free speech protected under 29 U.S.C. § 411(a)(2). The district court granted summary judgment in favor of defendants/appellees on the ground that Davis failed to exhaust his internal union procedures before seeking judicial intervention.
