*715In a proceeding pursuant to CPLR article 78 to prohibit the respondents from prosecuting six summonses and issuing any additional summonses for alleged violations of Kings Point Village Code § 161-50.2 (A) on the ground that any such actions are barred by a previous prosecution, the petitioner appeals from a judgment of the Supreme Court, Nassau County (Adams, J.), dated November 4, 2009, which, in effect, denied the petition and dismissed the proceeding.
Ordered that the judgment is affirmed, with costs.
