KELLY, Associate Judge:

This appeal is from a judgment for unpaid rent of $39.50 entered in the Small Claims and Conciliation Branch of the trial court.1 We reverse.

Appellee, assignee of Jeffrey Garden Apartments, filed suit against appellant, a tenant at sufferance of the assignor, for rent in the sum of $89.50 allegedly due for the month of September, 1966. The trial court entered judgment for $39.50, apparently crediting appellant with a $50.00 security deposit.
