— On the 10th day of June, 1878, the appellee obtained in the Hendricks Circuit Court a decree of foreclosure of a mortgage of real estate in said county, against Joseph L. Cook and wife and Martha ICinkead, and, in connoetion with the decree, an order appointing James W. Thompson a receiver in said cause, and directing him to take possession of said lands and receive and collect the rents and profits, and hold the same, subject to the order of said court, to be applied upon the ifiaintiffi’s debt, if said lands should fail to sell for the full amount thereof.
