This case arose under the Workmen’s Compensation Law. Gus Booth, appellee, presented his claim for compensation to the Industrial Accident Board, and, being dissatisfied with its award, brought suit in the district court to set same aside. The Texas Employers Insurance Association, the insurance carrier, among other defenses, urged a plea to the jurisdiction of the court, which was overruled, but, on appeal, was sustained by a majority decision of this court and the cause was dismissed.
