This is an action to enforce the lien of a special tax bill issued by the city of Independence, a city of the third class, in part payment of the cost of paving a portion of South Main street. The answer interposes a number of defenses. A jury was waived and after hearing the evidence the court rendered judgment sustaining the validity of the tax bill. Defendants appealed.
