This case came before the Supreme Court on March 6, 2013, pursuant to an order directing the parties to appear and show cause why the issues raised in this appeal should not summarily be decided. The state appeals from the entry of summary judgment in favor of its codefendant, the City of Providence (city). The state argues that the trial justice erroneously determined that the city had no duty to maintain the sidewalk where the plaintiff, Karen Lombardi, fell and was injured.
