MEMORANDUM AND ORDER
MAGNUSON, District Judge.
This matter is before the Court on Defendants U.S. Army Corps of Engineers, Brigadier General William T. Fasoli, and Colonel Kurt F. Ubbelohde’s Motions to Dismiss Plaintiffs’ Complaint and the Complaints of Intervenors Nebraska and South Dakota. In October 2003, Plaintiffs’ filed their opposition to the Motion to Dismiss and filed a cross-Motion for Partial Summary Judgment. In November 2003, Nebraska filed a Motion for Summary Judgment.
