Trespass to recover damages for an alleged wrongful conversion of 292 shares of plaintiff’s stock. At the trial, before Thayer, P. J., it appeared that, at the time of the alleged wrongful conversion, two hundred and ninety shares of stock in defendant’s corporation stood in the name of Charles H. Baker, deceased; and that John R. Baker was the surviving executor and testamentary trustee of decedent’s estate, to which trust plaintiff has- since succeeded.…

1Opinion of the Court

Per Curiam,

This is an important case both as regards the principles involved and the amount in controversy. The learned president of the court below has discussed it so well in his opinion refusing a new trial, that it is unnecessary to add anything to what he has so well said. We affirm the judgment for the reasons there given by him.

Judgment affirmed.
