This is an appeal from the district court of Kiowa county, wherein appellant, Bob Simmons, was convicted of the crime of grand larceny, and on February 19, 1938, was in accordance with the verdict of the jury, sentenced to serve a term of two- years’ imprisonment-in the state penitentiary.

The petition in error and case-made were filed in this court August 19, 1938.

The information jointly charged Bob Simmons, Alfred Dicks and Joe Dodson, with the larceny of one and one-half ton Wright Highspeed chain hoist, of the value of $50, the personal property of Parsons Brothers Granite Company, a…
