Appeal from circuit court, New York county. Action by William Egan against the Dry Dock, East Broadway Sc Battery Railroad Company. From a judgment entered on a verdict for plaintiff, and from an order denying motion for a new trial, made on the judge’s minutes, defendant appeals.

On the second day of November, 1893, the steam boiler in the defendant’s stable on East Fourteenth street, in the ■city of New York, exploded with great violence. A considerable portion of the building in which the boiler was situated was torn to pieces by the explosion, and fragments of the boiler were thrown across the street, with such force as to shatter the opposite buildings. Several persons were killed or injured by the explosion, and among those injured was the plaintiff, who brought this action to recover damages caused by the wounds he then received.
