Judd, J.:

This is an action of ejectment begun in- Beaver county, of this territory, upon a complaint which claims that the plaintiff below, appellant here, is the owner of all of lots 3 and 4, of section 7, in township 26 south, of range 6 west, Salt Lake base meridian, containing seventy-nine and eighty-two one-hundredths acres; and the complaint alleges that while plaintiff was the owner and so seized, and in and entitled to the possession of said land and premises as aforesaid, the defendant, on or about the twenty-second day of December, 1885, wrongfully, and without right, license, or…
