Reversing.

John Combs was indicted jointly with Joe Newberry and Dill Asher for the murder of Liew Banks. The indictment was in four counts, one count charging a conspiracy among the defendants to commit the' crime, and the others charging each of the defendants separately as principal with the others aiding and abetting in the murder of Banks. On a separate trial, Newberry was convicted, and his punishment fixed at life imprisonment, which was affirmed by this court. Newberry v. Commonwealth, 222 Ky. 630, 1 S. W. (2d) 1045.
