Appellant suffered a crushed left foot and leg when he was struck by a roller on October 24, 1952. To recover for his injuries, he instituted an action of trespass against appellee, the owner of the roller, whose employee was operating it at the time of the accident. The matter was tried before the Honorable William G. Johnstone, Je., and a jury, on October 2, 1961. Only the appellant testified, and at the conclusion of Ms testimony as to the circumstances of the accident, he rested as to liability. Appellee’s motion for compulsory nonsuit was granted by the…
