The claimant, Joyce Ann Morrow, allegedly sustained an on-the-job injury to her foot on January 29, 1987. She subsequently filed suit against her employer's workmen's compensation carrier, Travelers Insurance Company, after it refused to pay her medical expenses or disability benefits. The trial court denied the claimant benefits under the workmen's compensation laws of Alabama on the grounds (1) that she failed to prove that her accident arose out of and in the course of her employment and (2) that she failed to comply with the notice provisions mandated under § 25-5-78, Ala.
