Rothwax, J.), rendered January 18, 1984, which convicted defendant, upon his plea of guilty, of criminal possession of a weapon in the third degree and sentenced him, as a persistent violent felony offender, to a prison term of six years to life, consecutive to parole time owed, unanimously modified, on the law and in the interest of justice, to vacate the sentence and impose a sentence of to 5 years, as a second violent felony offender, consecutive to parole time owed, and otherwise affirmed.
