Plaintiff in error, Oliver Daniels, brought this suit in the district court of Gregg county against Pearl Wight, receiver of the Texas & Pacific Railway Company, for damages for depreciation in the market value of his property, consisting of a two-story residence on a certain lot of land in Longview, Tex. The main line of the railway company runs through the middle of its 'right of. way and is 120 feet distant from the residence of plaintiff in error.
