This matter was commenced in the State Industrial Commission April 20, 1943, when Henry Kelley, hereinafter called respondent, filed his first notice of injury and'claim for compensation stating that on or about April 1, 1943, he sustained an accidental injury arising out of and in the course of his employment with the McAlester Fuel Company.
