Petitioner Jay Eduard Krueger appeals from the trial court’s order upholding the decision of respondent, the North Carolina Criminal Justice Education and Training Standards Commission (“the Commission”), to suspend his law enforcement certification for five years. The trial court, in reviewing the Commission’s decision, failed to make the necessary determination under N.C. Gen. Stat. *571§ 150B-51(d) (2007) as to whether petitioner’s evidence gave rise to a genuine issue of material fact on his claims that the Commission’s decision was unconstitutional and/or arbitrary and…
