This action w!as instituted in the district court of Payne county by the defendant in error, hereinafter referred to as plaintiff, against the plaintiff in error, hereinafter referred to as defendant, and the American Surety Comp'any, to recover damages alleged to have been sustained as the result of a malicious civil prosecution. The American Surety Company is not a party to this appeal. The circumstances out of which this litigation arose will be briefly stated.
