WOODLEY, Presiding Judge.

The offense is operating a motor vehicle upon a public highway while intoxicated, after having been convicted of the misdemeanor offense of driving while intoxicated; the punishment, 90 days in jail and a fine of $100.

Chief Deputy Sheriff Raymond Spraberry testified, without objection, that he observed the appellant driving a pickup on a public highway in the City of Hamlin, in Jones County; that the pickup was weaving to one side and then the other; that he stopped appellant shortly after 10 o’clock P.M., observed him; talked with him and, from his conversation and…
