Defendant, Anthony Del Percio, was tried by jury and convicted of armed violence predicated upon attempt (armed robbery) (Ill. Rev. Stat. 1979, ch. 38, par. 33A— 2), attempt (armed robbery) (Ill. Rev. Stat. 1979, ch. 38, par. 8 — 4(a)), conspiracy to commit armed robbery (Ill. Rev. Stat. 1979, ch. 38, par. 8 — 2(a)) and unlawful use of weapons (Ill. Rev. Stat. 1979, ch. 38, par. 24 — 1(a)(7)). The trial court vacated attempt (armed robbery) as a lesser included offense of armed violence and sentenced defendant to eight years’ imprisonment…
