HIGGINS, Justice.
While crossing Commerce street in the city of Dallas, on July 22, 1929, appellee, Mrs. Hansen,- was struck by an automobile going eastward, driven by an employee of Southwestern Engraving Company of Dallas, in consequence of which she suffered serious personal injury. She brought this suit against said company on July 21, 1931, to recover damages for her injuries. In her first amended petition, filed July 3, 1933, upon which the cause was tried, she described herself as a widow, and the suit was to recover damages in her own personal right.
