Plaintiff filed an action in state court alleging claims of breach of contract and breach of express and implied warranties under state law. The ease was removed to this Court based on diversity jurisdiction. This matter is before the Court on the plaintiffs motion to remand (# 8) based on the presence of a Missouri defendant joined by a first amended complaint. The removing defendants oppose remand alleging that the plaintiff fraudulently joined the Missouri defendant for the sole purpose of defeating diversity jurisdiction. Responsive…
