Appeal by the plaintiff, John J. McDonald, from an order of the Supreme Court, made at the New York Special Term and entered in the office of the clerk of the county of New York on the 10th day of April, 1916.

McLaughlin, J.:

This appeal is from an order denying a motion to strike out or make more definite and certain portions of the answer. Pour causes of action are set out in the amended complaint, based upon four articles published in defendant’s newspaper in November and December, 1913. Annexed to and made a part of the complaint are extracts from, such articles which it is claimed libeled plaintiff. The substance of them is that plaintiff advised a bidder for a contract to construct the Hudson river siphon of the Oatskill aqueduct to see one McAvoy “to make arrangements ”so that the bidder…
