ROGERS, District Judge.

The complainant, the Alkire Grocery-Company, a mercantile corporation organized under the laws of the *80state of Missouri, brought suit in the circuit court of Boone county, Ark., which county is a part of the Western district of Arkansas, against the defendant Jesse B. Richesin, and, on the 26th day of July, 1898, recovered' a judgment against him for $3,264.66, and thereupon sued out a writ of execution on the judgment, and procured a nulla bona return; and afterwards, on the 27th of September, 1898, filed this creditors’ bill against Jesse R.
