This action is brought to recover an amount alleged to be due the plaintiff for services rendered as constable of Union township, Humboldt County, Nevada, for a period of a little more than two months It is alleged in the complaint that at the time of plaintiff’s appointment the salary of said office was $150 per month, and that thereafter the legislature passed an act, which was approved by the governor, fixing the salary at $5 per annum.
