Plaintiff was the duly elected, qualified, and acting constable in and for Union Township, Humboldt County, Nevada, during and for the period from June 1, 1921, to and including November 30, 1922. In 1909 the legislature fixed the monthly salary of the constable of that township at $150 per month. 1909 Stats, p. 144. In 1919 the legislature passed an act empowering the board of county commissioners of each county in the state to fix the compensation of the township officers. 1919 Stats, p. 395.
