This is an action of indebitatus assumpsit. The declaration contains the common counts, and an account stated, to which the defendant pleaded the general issue and the statute of limitations. By agreement, a general replication wás considered as filed to this plea, and the plaintiff permitted to give in evidence everything that he might under a special replication, and the defendant was permitted to give in evidence any facts that he might specially rejoin.
