This matter comes before the Court on the motion of Norwest Financial, Inc. (“NFI”) and Norwest Financial Illinois, Inc. (“NFIL”) (collectively, the “Defendants”) to dismiss Counts I — III of Patricia Holcomb’s (“Holcomb”) Second Amended Adversary Complaint (“Complaint”) pursuant to Federal Rule of Civil Procedure 12(b)(6), made applicable to bankruptcy proceedings by Federal Rule of Bankruptcy Procedure 7012.
